Little Float Volunteer Waiver

I, ________________________ desire to volunteer for Downtown Alliance of Milwaukie (DAM) and engage in the activities related to being a volunteer. I understand that the activities may include various tasks associated with the Little Float Milwaukie.

In return for being allowed to participate in Downtown Alliance of Milwaukie volunteer activities and all related activities, including any activities incidental to such participation (“Volunteer Activities”), the undersigned Volunteer or Parent/Legal Guardian of Volunteer if Volunteer is under age 18 (hereafter referred to using “I”, “me”, or “my”) releases and agrees not to sue the Downtown Alliance of Milwaukie or its officers, directors, employees, sub-contractors, sponsors, agents and affiliates (“the Foundation”) from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities wherever, whenever, or however the same may occur.

I hereby freely and voluntarily, without duress, execute this Release under the following terms:

1. Waiver and Release: I, the Volunteer, release and forever discharge and hold harmless Downtown Alliance of Milwaukie, City of Milwaukie, Milwaukie Parks Foundation, North Clackamas Parks and Recreation District, Clackamas County, its officials, employees, agents, volunteers, sponsors, and assigns from and against any and all claims, suits, liabilities and expenses (including but not limited to, damages, attorney fees, and costs) that may be asserted against the City of Milwaukie and Downtown Alliance of Milwaukie and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer work.
2. I understand that no compensation will be paid for the volunteer services provided by me, and no benefits traditionally associated with employment will be provided.
3. Unless expressly provided for by Little Float’s event insurance coverage, I am responsible for my own insurance in the event of bodily injury, personal injury, illness, death or property damage.
4. I understand that my volunteer activities may include hazardous work, such as lifting heavy objects, assisting people in and out of boats on the water, climbing, standing on platforms, using tools, directing vehicles, working in the open sun on sites with varied terrain, standing/wading/working in water and the river, monitoring crowds, alcohol monitoring, parking lot attendee, and related other hazardous activities. I am aware and fully accept the risk that any of these hazardous activities can create the possibility of serious injury, paralysis, drowning or even death. I agree to take necessary precautions to protect myself and my property.
5. I intimately understand my skills and bodily abilities and will NOT perform any hazardous activities that are outside of those skills and bodily abilities.
6. I promise to use reasonable care in completing all volunteer activities and will ask for all tools, supplies, and support necessary to complete volunteer activities in a way that results in a product or outcome that meets the ordinary standards of good workmanship’
7. Insurance: I understand that Downtown Alliance of Milwaukie does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance of any nature in the event of my injury, illness, death, or damage to my property.
8. Medical Treatment: I hereby release and forever discharge Downtown Alliance of Milwaukie any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my time as a volunteer.
9. Photographic Release: I grant and convey to Downtown Alliance of Milwaukie all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by Downtown Alliance of Milwaukie in connection with my volunteer provided services.
10. Other: I expressly agree that this Release is intended to be as broad and inclusive as permitted by law. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release.

By signing, I acknowledge that I have read and understood all of the terms of this Release and that I am voluntarily giving up substantial legal rights.
